California
SB
33: On April 19, 2005, the California Senate held
hearings on S.B. 33, Senator Jim Battin's “Circle of Trust”
bill. This landmark reform legislation would end California’s
24-year policy of giving convicted child molesters probation
instead of prison, as long as their victims are children living
in the same household. It would also remove strong legal incentives
for placing children into sex offender therapy with their molesters
and then reuniting them.
Illinois
HB
360: Amends the Illinois Marriage and Dissolution
of Marriage Act. Requires the court to determine whether counseling
is appropriate for a child who is involved in a custody proceeding.
Authorizes the court to order counseling and apportion the cost
between the parties.
Tennessee
HB
2848): The Protective Parent Reform Act provides
guidelines for any attorney who is appointed to represent a
child in a hearing for custody. It also prohibits the custody
courts from granting a change in custody of a child based on
a parent filing a good faith allegation of child abuse if the
Department of Children's Services fails to fully substantiate
or even investigate the allegation. Child abuse is to be considered
on a preponderance of the evidence instead of the more onerous
clear and convincing evidence or beyond reasonable doubt. The
Act also prohibits the courts from placing a child in the custody
of or in an uncontrolled visitation arrangement with a parent
who presents a substantial risk of harm to the child.
